June 11, 2018. Command Investigations and Johns Eastern Company announce that Michael Deluca plead no contest to insurance fraud on June 1, 2018, and was adjudicated guilty for the following charge:
Florida Statute 440.105(4)(B) – Workers’ Compensation Fraud
He was ordered to pay $6,333.35 in enforceable restitution to Johns Eastern Company and sentenced to five years of probation.
Deluca sustained an alleged work-related injury in October of 2015.
After the incident, he reported to his doctor that symptoms including headaches, vertigo and vision changes prevented him from working.
Additionally, he stated he couldn’t stand for more than 10 minutes at a time.
To validate these claims, Command Investigations initiated a social media investigation and surveillance to evaluate his activity levels.
During the investigation, Command discovered Deluca was working at a restaurant. Video was obtained of him working in the kitchen, carrying groceries, standing for prolonged periods of time, driving, entering and exiting his vehicle and climbing a ladder to perform repairs to outside signage.
Following the surveillance, Deluca provided a sworn statement that he had not worked since his alleged injury.
Further, he made clear and definitive statements that he was unable to carry groceries and bend at the waist. He denied suffering any previous injuries and said he had not received any prior medical treatment.
However, Command’s investigation revealed Deluca had a previous claim history.
Based on the evidence gathered, Command submitted a referral to the Florida Division of Insurance Fraud (DIF) based on material misrepresentation, as statutorily required.
Deluca was arrested in Hendry County, Florida on December 28, 2016.
