May 15, 2018. Command Investigations and PGCS Claims Services Inc. announce that Frank Martin has accepted a pre-trial diversion agreement (PTD).
Martin was ordered to pay PGCS $717.78 in enforceable restitution and assigned to complete one-year of a PTD program for the following charge:
- Florida Statute 440.105(4)(B) – Workers’ Compensation Fraud
Martin suffered an alleged work-related injury while employed as a Firefighter/EMT and stated he was unable to work due to his mental and physical conditions.
In addition, he completed DWC-19 forms and declared he was not receiving secondary income or employed while receiving workers’ compensation benefits.
However, Command began an investigation into Martin after receiving information that he may have been working as a boat captain.
Subsequently, Command obtained video of Martin working for a dive and tour boat company. He was documented operating vessels, assisting scuba divers and performing tasks beyond his stated physical restrictions.
Based on the evidence gathered, Command’s Special Investigative Unit (SIU) was statutorily required to refer Martin’s claim to the Florida Division of Insurance Fraud (DIF).
He was arrested on October 24, 2017 in Citrus County, Florida.
