Final Disposition: Probation Time Served (Jose DelValle)

May 13, 2015. Command Investigations and Frank Winston Crum Insurance Company announce a final disposition for Jose DelValle, which included DelValle serving six months of probation.

Command Investigations, serving as the SIU Department of Frank Winston Crum Insurance Company, initiated an investigation on Jose DelValle after he allegedly sustained a left shoulder injury slipping from a 3-foot ladder while painting on a jobsite. During Command’s surveillance, DelValle was captured participating in physical activities, including utilizing tools, lifting lumber and a ladder, and playing baseball games where he ran, threw and caught a baseball and extended his arms above his head. Based on his misrepresentation, a referral was submitted to the Florida Division of Insurance Fraud (DIF) as statutorily required.

Consequently, on September 23, 2014, DelValle was arrested in Volusia County, Florida and charged with insurance fraud, violating F.S. 440.105(4)(b), F.S. 817.234(11)(a) and F.S. 812.014(2)(b)(1). On April 16, 2015, he was convicted and plead guilty to one charge of F.S. 440.105(4)(b) – WORKER’S COMPENSATION FRAUD and one charge of F.S. 817.234(11)(a) – FALSE AND FRAUDULENT INSURANCE CLAIM LESS THAN $20,000.
