Final Disposition for Insurance Fraud: $5,000.00 in Restitution Paid to the Carrier and Probation Time Served (Daniel Valdes)

May 12, 2015. Command Investigations and SUNZ Insurance announce the final disposition on insurance fraud for Daniel Valdes.

Valdes paid $5,000 in restitution to the Carrier and served his probation time.

Serving as SUNZ’s SIU Department, Command Investigations conducted an investigation on Daniel Valdes after he claimed to have sustained a back sprain from moving boxes into the back of a truck while working as a driver. The claimant sought treatment and denied any previous back injuries. Command obtained information from an index report of the claimant that revealed multiple workers’ compensation claims and two motor vehicle accidents.

Because Valdes misrepresented previous back injuries or treatment, Command determined that the claimant presented false and misleading information regarding the facts to his claim. Supporting evidence was gathered and the claim was referred to the Florida Division of Insurance Fraud (DIF) as statutorily required.

Based upon the SIU investigation, on June 28, 2013, the entire claim was denied for misrepresentation. On October 17, 2013, the claim was ultimately settled for $6,500. However, the Florida Division of Insurance Fraud (DIF) pursued criminal charges despite the settlement. Subsequently, an arrest warrant was issued for Valdes.

On November 17, 2014 in Dade County, Florida, Valdes was arrested for insurance fraud, in violation of F.S. 440.105 (4)(b) WORKERS COMPENSATION FRAUD.

Consequently, Valdes was arrested, and on April 13, 2015, he was convicted and plead guilty to one count of F.S. 440.105 (4)(b) – Workers’ Compensation Fraud.
