ARRESTED for Insurance Fraud (Jason Shirling)

JasonMarch 10, 2015. Command Investigations and SUNZ Insurance announce the arrest of Jason Shirling.

Serving as the SIU Department of SUNZ, Command Investigations conducted an investigation on Jason Shirling after he claimed to have obtained multiple injuries falling from a rooftop while working as a construction worker. Command obtained multiple days of video footage of the claimant moving in an unrestricted manner and completing significant physical tasks, including motor vehicle work and extensive garden and yard work.

During both of Shirling’s depositions on August 1, 2013 and October 29, 2013, he testified to having difficulty walking and standing and denied participation in physically intensive activities including any gardening.

Because surveillance video contradicted both of Shirling’s deposition, Command determined that the claimant presented false and misleading information regarding the facts to his claim. All additional supporting evidence was gathered and this claim was referred to the Florida Division of Insurance Fraud (DIF) as statutorily required.

Based upon the SIU investigation, on November 4, 2013, the entire claim was denied for misrepresentation. On November 25, 2013, the claim was ultimately settled for nearly $40,000. However, based the clear violation of F.S. 440.105, the Florida Division of Insurance Fraud (DIF) pursued criminal charges despite the settlement. Subsequently, an arrest warrant was issued for Shirling.

On February 12, 2015, Shirling was arrested in Evansville, Indiana for workers’ compensation fraud, in violation of F.S. 440.105, and perjury in an official proceeding, in violation of F.S. 837.02. He was extradited back to Florida on March 4, 2015 for criminal trial.  Shirling received a $5,000 bond and was bonded out on March 5, 2015.  Shirling’s criminal trial is pending.

All parties are presumed innocent until proven guilty.
